Acceptance of These Terms

These Terms of Service (“Terms”) govern access to and use of colonialnaturalproducts.com and purchases from Colonial Natural Products. By accessing the store, placing an order, or using our services, you agree to these Terms and the policies incorporated by reference, including the Privacy Policy, Shipping Policy, Refund Policy, Cookie Policy, and Food and Dietary Supplement Disclaimer.

If you do not agree, do not use the store. These Terms do not exclude consumer rights that cannot legally be waived.

Eligibility and Customer Responsibilities

You must have legal capacity to enter into a binding agreement or use the store with appropriate parent or guardian involvement. You agree to provide accurate, current, and complete account, billing, shipping, and contact information and to promptly update it when necessary.

You may not use the store for unlawful, fraudulent, abusive, or unauthorized purposes; interfere with store security; upload malicious code; scrape or copy the store in violation of law; or violate intellectual-property rights.

Products and Information

We make reasonable efforts to describe products accurately. Natural products may vary in color, texture, taste, aroma, moisture, granulation, and appearance. Images are illustrative and screens may display colors differently.

Product descriptions, labels, ingredients, weights, packaging, prices, and availability may change. The product label and packaging received should be reviewed before use. If website information conflicts with the current product label, contact us before consuming the product.

Food, Allergens, and Dietary Supplements

Products may contain or be processed near allergens. Peanut butter contains peanuts. Customers are responsible for reviewing ingredient and allergen information before purchase and use.

Dietary supplements and wellness products are not intended to diagnose, treat, cure, or prevent disease. Statements about dietary supplements have not been evaluated by the U.S. Food and Drug Administration unless expressly stated otherwise. Information on the store is general and is not medical, nutritional, or professional advice.

Consult a qualified healthcare professional before using supplements if you are pregnant, nursing, taking medication, have a medical condition, are planning surgery, or are purchasing for a child. Stop use and seek professional advice if an adverse reaction occurs.

Orders and Acceptance

An order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasons including inventory errors, pricing mistakes, suspected fraud, payment problems, shipping restrictions, legal restrictions, reseller activity, or inability to fulfill.

An order-confirmation email acknowledges receipt but does not necessarily constitute acceptance. Acceptance occurs when we confirm fulfillment or shipment, subject to applicable law. If we cancel a paid order, we will refund the amount charged for the cancelled items.

Prices, Taxes, and Payment

Prices are shown in the currency displayed at checkout and may change without notice. Taxes, shipping, customs duties, and other charges are added where applicable.

You authorize us and our payment providers to charge the selected payment method for the order total. You represent that you are authorized to use the payment method. We may correct pricing or typographical errors and may cancel an affected order with a refund where required.

Promotions and Discount Codes

Promotions may have separate terms, expiration dates, product restrictions, minimum purchases, usage limits, and geographic restrictions. Unless stated otherwise, offers cannot be combined, exchanged for cash, or applied retroactively. We may modify or end promotions where permitted by law.

Shipping, Delivery, and International Orders

Shipping is governed by the Shipping Policy. Processing and delivery estimates are not guarantees. International customers are responsible for import legality, customs duties, taxes, brokerage charges, and other destination fees unless checkout states otherwise.

Risk, responsibility, and remedies for shipment loss or damage are determined under applicable law, carrier records, and the Shipping and Refund Policies.

Returns, Refunds, and Cancellations

Returns, refunds, replacements, and cancellations are governed by the Refund Policy. Consumable food and supplement products are generally final sale once shipped, except for damaged, defective, incorrect, missing, contaminated, or potentially unsafe items and rights required by law.

Bulk and Commercial Orders

Bulk, wholesale, restaurant, retailer, and commercial orders may require separate written quotations, minimum quantities, freight arrangements, payment terms, lead times, or agreements. A website order does not guarantee wholesale pricing or supply continuity. Separate written terms control if they conflict with these Terms.

Intellectual Property

The store and its content—including text, graphics, photographs, logos, product names, design, software, and compilation—are owned by or licensed to Colonial Natural Products and protected by applicable intellectual-property laws.

You may use the store only for personal, lawful shopping and information. No content may be copied, reproduced, modified, distributed, sold, republished, or commercially exploited without prior written permission, except as permitted by law.

User Content and Reviews

If you submit a review, photograph, comment, testimonial, or other content, you represent that you have the right to submit it and that it is accurate, lawful, non-infringing, and not misleading.

You grant Colonial Natural Products a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display submitted content in connection with the store and marketing, subject to applicable law and our Privacy Policy. We may moderate or remove content but are not obligated to do so.

Third-Party Services and Links

The store may use or link to third-party services, including Shopify, payment providers, shipping carriers, analytics services, social platforms, and apps. Third parties operate under their own terms and policies. We are not responsible for third-party services beyond responsibilities imposed by law.

Prohibited Conduct

You may not use the store to violate law; infringe rights; submit false information; transmit malware; gain unauthorized access; interfere with functionality; collect personal information unlawfully; engage in fraud, chargeback abuse, or resale schemes; or use automated systems in a manner that burdens or damages the store.

Disclaimer of Warranties

To the fullest extent permitted by law, the store and services are provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or completely secure operation or that all information will always be current.

Any implied warranties that cannot legally be excluded remain in effect for the minimum period required by law. Nothing in these Terms excludes express product commitments we make in writing.

Limitation of Liability

To the fullest extent permitted by law, Colonial Natural Products and its owners, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, or business opportunity arising from use of the store or products.

Where liability cannot be excluded, aggregate liability will not exceed the amount paid for the product or order giving rise to the claim, except where a different remedy is required by law. These limitations do not apply to fraud, willful misconduct, personal injury caused by negligence, or other liability that cannot legally be limited.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Colonial Natural Products from claims, losses, and reasonable costs arising from your unlawful use of the store, violation of these Terms, infringement of another person’s rights, or misuse of products contrary to labels or instructions. This section does not apply where prohibited by consumer law.

Governing Law and Disputes

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles, except where mandatory consumer law in your place of residence applies.

Before filing a formal claim, please contact support@colonialnaturalproducts.com and provide a description of the dispute and requested resolution so the parties can attempt a good-faith resolution. Nothing here prevents either party from seeking relief in small claims court or exercising rights that cannot be waived.

Severability; No Waiver; Entire Agreement

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions remain effective. Failure to enforce a provision is not a waiver.

These Terms and incorporated policies form the entire agreement regarding the store and purchases, except for separate written terms governing bulk or commercial orders.

Changes to These Terms

We may update these Terms to reflect operational, legal, or regulatory changes. The updated version will be posted with a revised date. Continued use after the effective date constitutes acceptance to the extent permitted by law.
